By clicking “I AGREE” or by using this app, you will be deemed to have accepted the Terms and Conditions. If the Terms and Conditions are not acceptable to you, please do not use this app and uninstall this app from your device. By accepting the Terms and Conditions, you will be entering into a binding agreement with Shangri-La International Hotel Management Limited and its affiliates and subsidiaries (collectively, “Shangri-La”) and the hotels, resorts and properties managed by Shangri-La (each a “Hotel” and collectively, “Hotels”) for the use of this app. The use of “we” or “us” refers to Shangri-La and the Hotels.

Use of the App

This app allows users to access the reservation services of Hotels under the Shangri-La, Kerry, JEN and Traders brands, to purchase and/or use Shangri-La Gift Cards (Vouchers) (in the People’s Republic of China only) as well as to use various digital functions available upon check-in.

This app also provides marketing and promotional information about products, services and activities on offer by Shangri-La and Hotels.

Members of Shangri-La Circle may use this app for loyalty programme services including redemption services and mobile check-in and check-out services (where applicable).

This app and its content are made available to you for personal, non-commercial use. This app should not be used for unlawful, immoral or illegal purposes or for any purpose other than those stated in the Terms and Conditions. We reserve the right to deny access to any user who violates the Terms and Conditions, the Privacy Policy, the Cookies Policy or at our sole discretion.

You must be of sufficient legal age and capacity to make reservations for rooms, restaurants or spa services, or to purchase goods and services or the Shangri-La Gift Cards (Vouchers) on offer through this app.

You must not engage in any conduct or do anything that would damage, impair or interfere with the operation or security of this app, the system hosting the app, or any of our computer systems.

Intellectual Property

The app contains proprietary information, content and materials, including but not limited to text, graphics, images, photographs, videos, music, sound, icons, logos, designs, trade names, trade secrets, patents, trademarks, software codes and technologies (“Content”), that is owned by Shangri-La and/or third parties and is protected by applicable intellectual property and other laws, including but not limited to copyright. No licence is granted in respect of those intellectual property rights. Your use of the app does not grant, transfer to or confer upon you any right, title or interest in the Content.

By using the app, you agree to comply with all end user agreements and privacy policies of third parties, including but not limited to clause 4 of Amap API Terms of Service (https://developer.amap.com/home/terms/), clauses 9.3 and 9.4 of Google Maps APIs Terms of Service (“Google Terms”) (https://developers.google.com/maps/terms) and OpenStreet Map licenced under www.opendatacommons.org/licenses/odbl and attributed at www.openstreetmap.org. In accordance with clause 10.3 of Google Terms, we hereby notify end users that we have modified the maps by incorporating number identifiers which cross refer to place names.

You agree that you will not use the Content in any way whatsoever except for use of the services available on the app in compliance with the Terms and Conditions. The app may only be used for personal and non-commercial purposes. You must not use, copy, modify, publish, reproduce, distribute, re-transmit, transfer, upload, download, sell, licence, reverse engineer, decompile, or disassemble the Content, without the prior written consent of Shangri-La except to the extent permitted by copyright laws. You must also not engage in any conduct that infringes, violates or misappropriates any intellectual property rights of Shangri-La or any other party, and such infringement, violation or misappropriation shall amount to a breach of the Terms and Conditions.

You must not use the app or any of its functions (e.g. Screencasting function) in any manner or for any purpose that may knowingly violate any law or regulation, or be in breach of any licence which restricts the transfer, uploading or downloading of content onto another device, or any right of any person including, but not limited to, intellectual property rights, rights of privacy, or which otherwise may be harmful, in our sole discretion, to us or any other person. In particular, you are prohibited from using the Screencasting function for any illegal, improper or unauthorized activities such as downloading, possessing or streaming any content which infringes copyright.

Feedback page is available for you to send your comments, suggestions, ideas, or feedback concerning the app or any of the services made available to you on the app (“Feedback”). You agree that if you provide any Feedback to us, we will own all right, title and interest in and to the Feedback, even if such Feedback is provided in confidence. We will be entitled to use the Feedback without restriction. You irrevocably assign to us all right, title and interest in and to the Feedback and agree to provide us with any assistance we may require to document, perfect and maintain our rights in the Feedback.

Shangri-La Circle Membership Account

You may freely search the app and its functionality without an account.

If you are already a member of Shangri-La Circle Programme, you can use your existing membership number, email address or mobile number and password (“Login Details”) to access your account on the app. You can enrol as a member of Shangri-La Circle Programme via the app and create an account by providing your personal information (either by completing an enrolment form or by binding other social media accounts such as WeChat etc). This information will be stored and used in accordance with the Privacy Policy.

For Shangri-La Circle members in the People’s Republic of China requiring a Fapiao for tax purposes, additional information such as Company name, tax identification number, address, telephone number, and bank account details may be required under applicable laws. This service is only available in some hotels and resorts within the People’s Republic of China.

You must provide genuine, accurate, complete and up-to-date information when creating an account. You are required to update your account information regularly. We reserve the right to cancel or deny access to any account found to contain false, fictitious, erroneous or outdated information.

Once your account has been set up, you have access to your Shangri-La Circle Award Points which can be redeemed for room nights, vouchers for spa services, and food and beverage at participating hotels and outlets. As a Shangri-La Circle member, you are bound by all terms and conditions of Shangri-La Circle found here.

You are solely responsible for maintaining the confidentiality of your Login Details. Never disclose your Login Details to a third party. You will be responsible for all activities that occur under your account. You will be responsible for any reservations and purchases made under your account even if these are made on behalf of others.

Unless and until you notify us of any unauthorized access to your account, we have the right to assume that any transaction made on your account has been authorized by you. Reservations and Shangri-La Gift Cards (Vouchers) (Only available in the People’s Republic of China)

By using this app to make reservations with a Hotel or to purchase and/or use the Shangri-La Gift Cards (Vouchers) at a Hotel in the People’s Republic of China, you agree to be bound by all of such Hotel’s standard terms and conditions and by any other policies, terms and conditions that may apply, including the terms and conditions of the Shangri-La Gift Cards (Vouchers) found here.

By using this app to make reservations or to purchase and/or use the Shangri-La Gift Cards (Vouchers), you hereby authorize the Hotel and us to use your personal information including credit/ debit card information that we have in your account for the purpose of the reservation or the purchase and/or use of the Shangri-La Gift Cards (Vouchers).

By using this app or information otherwise provided by Shangri-La or Hotels to make reservations at any of the Hotels or to purchase and/or use the Shangri-La Gift Cards (Vouchers) at a Hotel in the People’s Republic of China, you acknowledge that there may be technical inaccuracies, typographical errors or mistakes in the information displayed or otherwise provided including but not limited to room rates, occupancy levels, availability or other Hotel requirements. Neither Shangri-La or Hotels assume responsibility or liability for any such inaccuracies, errors or mistakes nor be obliged to honor reservations or Shangri-La Gift Cards (Vouchers) based on such inaccuracies, errors or mistakes. Shangri-La and Hotels reserve the right to make changes, corrections, cancellations and/or improvements to information displayed on this app or otherwise provided by Shangri-La or Hotels, at any time without notice, including confirmed reservations or Shangri-La Gift Cards (Vouchers) based on such inaccuracies, errors or mistakes in the information provided or displayed on this app.

You may only make reservations rooms or purchase the Shangri-La Gift Cards (Vouchers) through this app for yourself and your guests.

If you intend to book more than nine (9) rooms at the same Hotel for the same period of stay on behalf of one or more guests, you must contact the Hotel directly to make your reservations.

Hotel reserves the right to require proper proof of identity (e.g. passports or national identity cards) from any person checking in. Hotel has the absolute discretion to refuse to check in any guest who is unable to provide proper proof of identity. Hotel also has the absolute discretion to refuse to accept the Shangri-La Gift Cards (Vouchers) if no or invalid verification information is provided.

You are prohibited from using this app for the purposes of reselling, advertising or marketing the reservations and/or the Shangri-La Gift Cards (Vouchers) (whether online or otherwise) to third parties including online agents, third-party owned websites, or travel agents.

We reserve the right to cancel or modify at our sole discretion any reservations or the purchase and/or use Shangri-La Gift Cards (Vouchers) that have been made in breach of the Terms and Conditions or for false, fraudulent or unauthorized purposes.

Cancellation Policy for Room Reservations

The cancellation policy of any reservation may vary depending on the room rates, occupancy levels, availability or other Hotel requirements. The cancellation policy will normally be provided to you along with the confirmation of your reservation. Any cancellation of your reservation through this app must comply with the cancellation policy applicable to the reservation.

Notwithstanding the foregoing, it is our standard cancellation policy that in the event of a cancellation of your guaranteed reservation less than 24 hours prior to 6.00 pm of your scheduled arrival date (according to the local hotel time), or in case you fail to show up without a valid reason, the Hotel has the right to debit a one-night cancellation charge from the credit/ debit card provided to secure the reservation and/or saved in your account.

Credit/ Debit Card Information

As of 1 January 2018, you must provide valid credit/ debit card information (such as card type, card number, expiry date and the full name shown on the card) to us and to the Hotel to secure your reservation to pay an advance deposit for prepaid or advance purchases or to purchase the Shangri-La Gift Cards (Vouchers). No payment will be deducted from your credit/ debit card at the time of reservation unless it is for prepayment advance purchase or purchase of the Shangri-La Gift Cards (Vouchers).

You may choose to save your credit/ debit card details in your account for future use. This is optional and will expedite your future reservations and purchases made via this app. The collection of your credit/ debit card details is subject to our Privacy Policy. It is your responsibility to update your credit/ debit card details on your account. If your credit/ debit card is invalid or has expired, you will not be able to complete your reservation or purchases.

By providing your credit/ debit card information, you represent and warrant that (i) you are legally authorized to use the credit/ debit card you provided; (ii) you authorize us to charge you in full for all charges incurred by you and your guests (if applicable) or charged to your account for all products and services purchased and any damage or loss caused by you and your guests during your stay (including, without limitation, damage to the Hotel’s property); (iii) you authorize us to charge you in full the prepayment or advance purchase at the time of reservation or the purchase of the Shangri-La Gift Cards (Vouchers); and (iv) you authorize us to charge any cancellation charges to your credit/ debit card.

While all reasonable security measures will be taken to secure your credit/ debit card information, you agree to hold us and our employees and officers harmless and release us from any actions, claims, liability, damage or loss resulting from any loss, release, compromise, or disclosure of your credit/ debit card information caused by malware attacks, phishing attacks, viruses, hacking activities, malicious software and any other unlawful interference of the app’s operating system or unauthorized access by third parties.

Payment

Where applicable, you may charge the purchase of goods and services including food and beverage, spa services or other Hotel activities to your room during your stay or use the Shangri-La Gift Cards (Vouchers) which are valid and acceptable by the Hotel. You are personally liable for the full payment of all such charges which may include any applicable service charges, duties, taxes, or tariffs. You are required to pay and settle all such charges fully upon receipt of the Hotel bill or during check-out.

All payments made by you are subject to your respective bank’s charges for foreign transaction fees, where applicable. Additional foreign exchange fees may also apply if any other currency, which is not from your originating issued card’s country, is selected to be charged.

Cash & Points(Room Awards)

1. Members may redeem Room Awards at a participating hotel by using a combination of Cash & Points.

2. Cash & Points are applicable on the “Flexible Rate” and “Flexible Rate with Breakfast” and for specific Room Types only. Prevailing government taxes and service charges apply to the stay and such taxes/charges may vary for each participating hotel based on applicable regulations. Any associated charges must be paid by the Member at check-out. The redemption rate for each Room Award is 15 (fifteen) Points to 1 (one) US$ or local currency equivalent. A minimum of 500 Point is required before a Room Award can be redeemed with a combination of Cash & Points.

3. Member can only redeem one room under his/her name at any point in time when a reservation made under Cash & Points.

4. Cash & Points cannot be redeemed in conjunction with any other offers or promotions unless specifically permitted by the Terms and Conditions that accompany Redemption Awards. 

5. Upon confirmation of a Cash & Points reservation, a Member will need to cancel and make a new reservation for any changes, including change of hotel, room type, date of check-in, length of stay or guest name. The new reservation is subject to prevailing Flexible Rate or Flexible Rate with Breakfast, room availability, cancellation rules, policies and penalties at the time of the new reservation.

6. Cash & Points reservations are subject to reservation requirements and cancellation policies at the participating hotel.

7. Points used in connection with the Cash & Points reservation will be used to settle any cancellation penalty in the first instance. Any cancellation penalty that cannot be settled with Points will be charged to the credit card provided. Any remaining Points after cancellation penalty is deducted will be credited back to the Member’s account and such Points will retain their original expiry date. Expired Points will not be extended when the cancellation penalty is being processed.

8. Points will not be refunded for a no-show on the Cash & Points redemption and the remaining cash portion (if any) will be deducted from the credit card.

9. Member will not be able to earn Points on Room Rate for Cash & Points redemption booking, whether such redemption booking is made using full Points or partial cash plus Points. Member may earn Points on their incidental spend.

*These terms and conditions apply to Cash & Points only. Cash & Points are subject to the Shangri-La Circle Terms and Conditions. Any terms that are not specified herein are set out in theShangri-La Terms.

Mobile Check-In and Check-Out (Shangri-La Circle Members Only)

Members of the Shangri-La Circle may have access to the Mobile Check-In and Check-Out functions on this app if they have made their reservations directly with Shangri-La’s channel network, such as this app, Shangri-La’s website, Shangri-La’s reservation call centre or directly with a Hotel.

To use this function, you will be required to indicate your estimated arrival and departure time as well as register additional personal information (if not provided previously) such as date of birth, passports or national identification document numbers, and residential address in order for the Hotel to prepare for your arrival or departure ahead of time.

By opting to use this function, you specifically authorize us to use and release your personal information including credit/ debit card information to the Hotel for the purposes of your mobile check-in registration and mobile check-out settlement.

At the time of Mobile Check-In, you authorize the Hotel to place a hold of up to three (3) times the daily room rates (which includes room rates and estimated incidental charges during your stay) on the credit/ debit card provided to us at the time of reservation or a different credit/ debit card used for Mobile Check-In. If your reservation is made by way of room award redemption, you authorize the Hotel to place a hold of the daily estimated incidental charges during your stay on your credit/ debit card provided at the time of reservation. Once you have successfully settled your bill in full, Hotel will release the hold. If the pre-authorisation is unsuccessful, you will not be able to complete the Mobile Check-In process so you must check in at the Front Desk of the Hotel.

If you have booked multiple rooms at the same Hotel for the same period of stay on behalf of one or more of your guests, you can only complete the Mobile Check-In process for your own room, and your guests must separately check in either at the Front Desk of the Hotel or by using the app on their own devices.

The Hotel will endeavor to assign you your required room before your expected arrival time subject to availability.

The Hotel reserves the right to require proper proof of identity (e.g. passports or national identity cards) from all persons checking in. The Hotel has the absolute discretion to refuse to check in if the identity does not match with the person mentioned in your reservation or if anyone refuses to provide the requisite proof of identity to the Hotel.

If an additional person, who is not mentioned in your reservation, is going to stay with you, this additional person’s registration information (e.g. full name, contact details, date of birth, passports or national identity cards) must also be provided at the time of check-in via the Mobile Check-In process or at the Front Desk of the Hotel.

If you wish to check out before your confirmed departure date, you must inform the Hotel upon arrival. If you fail to do so and check out prior to your confirmed departure date, the Hotel is entitled to charge full room rates according to the departure date confirmed in your reservation.

Assuming no further information is required from you, you will be given a room key at the designated Mobile Check-In area of the Hotel without any further need to fill in a registration form, subject to local laws and regulations. By accepting the room key, you will be deemed to have accepted the terms and conditions of stay applicable to the Hotel.

The laws of some countries require hotels to inspect, scan or photocopy personal identification documents such as passports, visas and national identification documents. In such cases, you may be asked to present these documents at the designated Mobile Check-In area to complete the check-in process.

Once you have completed the Mobile Check-In process, modifications to your reservation can only be made directly at the designated Mobile Check-In area of the Hotel.

You agree that your use of this app for registration or purchasing any products or services shall constitute your agreement and intent to be bound by such terms including cancellation and refund policies, and to pay for the related transactions.

This app will show an itemized folio of the products and services that you have purchased as well as incidental charges that you have incurred during your stay. In the event of any queries or disputes concerning these charges, you should raise these queries and concerns immediately with the Hotel.

Upon confirmation of your Mobile Check-Out through this app, your room charges, all other incidental expenses that have been incurred, and all damages or loss caused by you or your guest (including, without limitation, damage to the Hotel’s property) during your stay will be charged to the credit/ debit card, which was used at the time of Mobile Check-In, provided to secure your reservation, or saved in your account (whichever is available).

During the Mobile Check-Out process, you may request an itemized folio of charges and incidental expenses incurred during your stay. This will normally show the total amount due with details of room rates, incidental charges, any damage or loss caused to the Hotel, and all applicable duties, taxes and other related charges payable by you. The total amount shown is subject to change in case of any additional late charges (e.g. any undeclared mini-bar consumption, food and beverage consumption or spa treatments received after completing the Mobile Check-Out process). Your banks or credit/ debit card companies may charge an international transaction fee, depending on the country and currency, which will not be part of the charges from Hotel. For more details of these charges, please contact your banks or credit/ debit card companies.

You can choose to receive your folio by email or collect a physical copy from the Front Desk of the Hotel before you leave the Hotel. Should you require a Fapiao, you can collect a hard copy from the Front Desk before your departure. After successful completion of the Mobile Check-Out, you may leave the room key in your room or at the Front Desk of the Hotel.

If you wish to pay by credit/ debit card which is different from the one you provided at the time of check-in or choose a different payment method to settle your bill, you must check-out from the Front Desk of the Hotel.

If you choose to check out of the Hotel without settling your bill in full or if the payment is unsuccessful after you have completed the Mobile Check-Out, you expressly and irrevocably authorize us to charge to your credit/ debit card, which was used at the time of Mobile Check-In, provided to secure your reservation or saved in your account, all charges you and your guests may have incurred, including any damage or loss caused by you or your guests to the Hotel during your stay.

Mobile Key (Only available in Participating Hotels)

Members of the Shangri-La Circle may have access to the Mobile Key function on this app if they have checked in at certain designated rooms at the Futian Shangri-La, Shenzhen and Shangri-La Zhoushan(“Participating Hotels”).

The Mobile Key will allow you to access an allocated room and lifts at the Participating Hotels. By using the Mobile Key, you will be deemed to have accepted the terms and conditions of stay applicable to the Participating Hotels.

For one allocated room, only one device of yours will be issued with the Mobile Key. If there are other guests staying with you in the same room, you may ask for additional room keys from the Front Desk.

It is your responsibility to safeguard your device with the Mobile Key. If you lose your device during your stay, you must inform the Front Desk immediately who can disable the Mobile Key and re-issue with additional room keys.

The Mobile Key will be automatically extended if you extend your stay, and will automatically be disabled upon check-out.

Valuables

You are advised not to bring expensive jewellery, precious goods or excessive amounts of cash onto the Hotel premises and you do so at your own risk. While Hotels provide reasonable security, Hotels are not designed as high security areas for the safekeeping of expensive jewellery, precious goods or large sums of cash. Please ensure that all items of value are always stored securely and not left unattended. Safety deposit boxes and in-room lockers are available free of charge for your use. To the extent permissible by law, we will not be liable for any loss of or damage to any property brought onto the Hotel premises. In the event that we are found to be liable for any such loss or damage, we shall not be liable for such loss and damage to an amount exceeding the statutory limitation available under the applicable local laws and regulations.

Privacy Policy

We respect your privacy and are committed to protecting the privacy, confidentiality and security of the personal data you provide to us or that we otherwise collect about you when you use this app. How we collect, use and disclose your personal data (including sensitive personal data (where applicable) and overseas transfers of your personal data) is set out in our Privacy Policy found here. Your continued use of and access to this app constitutes your acceptance of our Privacy Policy.

By using this app, you consent to receiving direct marketing and promotional communications from us. Accordingly, we will send you either via emails, SMS messages, push notifications, telephone calls, post, or social media (e.g .WeChat and Facebook) marketing and promotional information that we think may be of interest to you. You may opt-out from receiving further marketing communications from us at any time by following the unsubscribe instructions contained in the marketing communications or contacting us by email at [email protected].

Notwithstanding the above, and to the fullest extent permitted by law, you agree that in the event we are held liable for any damages related to this app, your sole and exclusive remedy will be limited to the amount you paid for services or products. With respect to services or products provided by third parties, we disclaim any and all liability relating to them. To the fullest extent permitted by law, you hereby waive any and all rights to bring any claim or action related to this app in any forum beyond one year after the first occurrence of the kind of act, event, condition or omission upon which such claim or action is based.

Indemnity

Consequences of Non-Compliance

If you fail to comply with the Terms and Conditions, without prior notice and without any liability to you or any other person, we reserve the right to take all or any of the following actions:

• cancellation or modification of your reservation(s) or transaction(s);

• cancellation of the Shangri-La Gift Cards (Vouchers) that you have purchased or used;

• issuance of a warning to you;

• termination, restriction or suspension of your use of or access to any or all part of the app;

• commencement of legal action against you; or

Hotel Policy

By making reservations with any Hotel or by purchasing and/or using the Shangri-La Gift Cards (Vouchers) at any Hotel in the People’s Republic of China, you agree to comply with and be bound by all house rules, regulations, disclaimers, waivers of liability, and policies as prescribed by the Hotel from time to time; all reasonable directions, orders and/or instructions imposed by the Hotel; and all applicable local laws and regulations of the country where the Hotel is located during your stay.

You are required to comply with the Hotel’s rules and regulations relating to the use of any of the Hotel’s facilities, equipment and services such as swimming pools, saunas and steam rooms, gymnasiums, spas, massage and beauty therapists, fitness instructors, beaches, water slides, and fitness equipment. The use of these facilities, equipment and services are entirely at your own risk. To the extent permitted by law, we shall not be liable for any personal injury or loss or damage to property caused to any person arising from or in connection with your use of the Hotel’s facilities, equipment and services.

For safety, security and housekeeping reasons, the Hotel reserves the right to enter a guest room at least once a day even if the “Do Not Disturb” sign is on.

Your non-compliance of any of the above will constitute a breach of the Terms and Conditions. In such an event, the Hotel reserves the right to take all necessary action, including without limitation the actions set out in “Consequences of Non-Compliance” above, requiring you to leave the Hotel with no compensation and/or seeking compensation for loss suffered by the Hotel.

Nothing contained in the Terms and Conditions shall constitute a waiver by the Hotel or shall compromise the Hotel’s rights to rely on and enforce all statutory limitations, defences and powers available to it under local laws and regulations.

Governing Law

Except to the extent that another laws are applicable to you during your stay and that such application cannot be waived or altered by contract, the Terms and Conditions shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (“Hong Kong”), without giving effect to conflicts of laws, rules or principles.

Arbitration

Any dispute, controversy, difference or claim arising out of or relating to the Terms and Conditions, including the validity, interpretation, performance, breach or termination thereof or any dispute regarding non-contractual obligations arising out of or relating to it shall be referred to and finally resolved by arbitration under the UNCITRAL Arbitration Rules in force when the Notice of Arbitration is submitted. The appointing authority shall be the Hong Kong International Arbitration Centre. The law of this arbitration clause shall be Hong Kong law. The seat of arbitration shall be Hong Kong. The number of arbitrators shall be one. The arbitration proceedings shall be conducted in English.

Amendment

We may amend the Terms and Conditions at any time without prior notice. Your continued use of the app after any such amendment constitutes your acceptance of the amended Terms and Conditions. If you do not agree to the Terms and Conditions or any revised version of the Terms and Conditions, please do not use the app.

Miscellaneous

We retain our right to exercise or enforce any right contained in the Terms and Conditions. In the event that we fail to take action, it shall not be deemed as a waiver of our right or prevent us from taking subsequent action in respect of that right or of any other right.

In the event of any provision of the Terms and Conditions being found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, the invalidity or unenforceability of such provision shall not affect the other provisions of the Terms and Conditions. All provisions not affected by such invalidity or unenforceability shall remain in full force and effect.

The Terms and Conditions are written in the English language and may be translated into other languages. In the event of any inconsistency between the English version and the translated version of the Terms and Conditions, the English version shall prevail.
